University Bands Constitution
Section 1- The name of this
organization is the Marquette University Bands.
Article
II- Purpose
Section 1- To provide Marquette
University with an instrumental music organization.
Section 2- To provide musical entertainment for various school functions. Section 3- To provide musically inclined students an opportunity to further their talents. Section 4- To provide social interaction between students of all colleges. Article
III- The Conductor
Section 1- The conductor has
control of all band matters, but must consult the governing board
before major decisions are made. All decisions will be made to
avoid conflict with school policy.
Article
IV- Membership
Section 1- Any student of
Marquette University with consent of director is eligible.
Section 2- Regular members are full-time undergraduate students enrolled in MUSI 030. Regular members are defined as those who meet the official attendance policy as defined in Article X. Anyone who does not meet the requirements of regular membership is eligible for associate membership. Section 3- Associate membership shall be open to any part-time student, graduate student, professional student, student enrolled in MUSI 030, faculty member, staff member, or administrator at Marquette University, at the consent of the conductor. Section 4- Membership can be denied or revoked by the conductor with input from the governing board at any time. Section 5- It is the policy of the Marquette Bands not to discriminate based on race, religion, color, creed, national origin, age, sex, marital status, sexual orientation, affectional preference, disability, or veteran status. Article
V- Officers
Section 1- The elected officers
of the bands shall be President, Vice President, Director of Finance
(Treasurer), Secretary, Directors of Public Relations, Director of
Small Ensembles, Historian, and Social Coordinators.
Section 2- The President: (one person) Presides at all officer meetings, consults the Conductor on all important issues, acts as a liaison between the conductor, officers, University Department heads, and band members, oversees all officers and their responsibilities, and works with the Small Ensembles Director in communicating with the University Athletic Department. Also appoints an officer or other band member to update Band events on the Internet. Section 3- The Vice President: (one person) Assists in the duties of the President, acts as temporary president in the absence of the president, acts as liaison between the president and other officers, coordinates and oversees Alumni relations, including, but not limited to, at least two (2) mailings each academic year (one before each concert), and organizes and compiles the Band and Officer E-mail accounts for mass mailings. Section 4- The Director of Finance (Treasurer): (one person) Keeps accurate records of all financial activities such as expenses and donations, prepares expense vouchers, coordinates t-shirt/sweatshirt sale, handles CD finances, and co-signs checks with the conductor. Section 5- The Secretary: (one person) Compiles a directory of all Band personnel at the beginning of the year and updates it at the beginning of the second semester, compiles a schedule of events for the Band with the conductor at the beginning of the academic year, records attendance of band members at required events (rehearsals, games, concerts, etc.), creates band personnel sections of concert programs, calculates stipends, and records the minutes at all officers’ meetings. Section 6- The Directors of Public Relations: (two people) Publicize band, jazz, and small ensembles concerts, and sales, as requested by the conductor and/or Governing Board, through flyers and posters, works with the University’s public relations representatives in utilizing the local media and any other promotional means in these endeavors. Also assists the conductor in any other areas of public relations, including concert programs, press releases, etc. Section 7- The Director of Small Ensembles: (one person) Facilitates small ensembles as needed, arranges small ensembles concerts if sufficient interest exists, acts as student director of Women’s basketball games and acts as a liaison to the University Athletic Department, including any associated meetings, picking up game tickets, and handling of all tournament affairs. Section 8- The Historian: (one person) Take pictures at all band functions and compiles them along with concert programs and other memorabilia into a yearly scrapbook, maintains a showcase of band events and functions, and prepares a slide show and/or other media presentation for the annual Dinner Dance. Section 9- The Social Coordinators: (two people) Organize and run band social functions dedicated to welcoming new members in the fall, promoting Band interaction through the year (through at least four (4) social events per academic semester), and thanking graduating Seniors in the spring, and organizing the annual Dinner Dance. Article
VI- Succession of Power
Section 1- If an officer is
unable to fulfill his or her duties and/or term, any current member of
the Governing Board and/or eligible band member may run for the office
for the duration of the term. Another election will be held for
the office within a reasonable amount of time.
Section 2- The other succession of power is: President, Vice President, Director of Finance, Secretary, Directors of Public Relations, Director of Small Ensembles, Historian, and Social Coordinators. Section 3- The successor will assume responsibility of the vacant office. That successor’s responsibility may be delegated among other officers at that succeeding officer’s direction. Article
VII- Election Procedure
Section 1- To
be eligible for the offices of President and Vice President, a
candidate must be a full-time undergraduate student enrolled in MUSI
030 with four full semesters of band participation. Candidates
for any other office must have two full semesters of band participation
and be a regular member. The candidate for President must have
previously held an office. All candidates should be selected
based on dependability, trustworthiness, leadership ability, ability to
perform the duties of his or her office to the best of his or her
ability, willingness to seek advice of senior officers, and loyalty to
the band, its members, and University authorities while fulfilling his
or her duties as an officer.
Section 2- On the Monday before the Spring Concert, it is recommended that each candidate post a platform for his or her intended office. Campaign materials may not be displayed or distributed before this date. After this date, posters may be displayed in designated areas in the Varsity Theatre, and flyers may be distributed. No other form of campaigning is allowed. The elections will be held in April on the Monday after the Spring Concert. Reading of the descriptions and responsibilities of each office shall precede the elections. Officers are determined by a simple plurality. Only regular members who fulfill the requirement of the official band attendance policy (Article X) may vote, run, or hold office. Section 3- All officers are elected for a term of one (1) year, beginning immediately after the elections are held. Section 4- Officers shall not be on academic or University probation at the time of elections and/or throughout their terms of office. Article
VIII- Impeachment Procedure
Section 1- Any member of the
Governing Board may initiate proceedings against any other member via a
formal written complaint to the Governing Board. The written
statement must prove just cause for the removal of the officer in
question. Written notification must also be given to the officer
in question no less than seven (7) days prior to the vote.
Section 2- The Governing Board shall determine by a two-thirds (2/3) majority vote that the complaint is of sufficient cause to be brought before the band. Section 3- The band shall impeach an officer through a three-fourths (3/4) majority of a quorum of present at impeachment proceedings. Band members must also be given seven (7) days notice that impeachment proceedings will be held. Article
IX-Governing Board
Section 1- There shall be a
Governing Board consisting of all elected officers. The Conductor
shall be an ex-officio member.
Section 2- The board shall be responsible for the formulation and execution of band policy. Section 3- The Board shall pass proposals by a simple majority, provided that two-thirds (2/3) of officers are present. Section 4- There shall be an officers’ meeting at least once per month. Article
X- Attendance
Section 1- Regular rehearsals are
determined prior to the start of the semester and will equal six (6)
hours per week.
Section 2- All rehearsals and performances, as well as the election following the Spring Concert and any other full band functions determined by the conductor and Governing Board, shall be considered official band business. The general expectation is for band members to attend all official band functions. Exceptions will be made for class conflicts (with the band member documenting such by providing a copy of their class schedule) or occasional work conflicts (with the band member documenting such by providing a copy of their work schedule). Other absences must be cleared with the Director beforehand, and will be dealth with on a case-by-case basis. Absences which are not related to a work or class conflict, or which have not otherwise been cleared with the Director, will be treated as unexcused absences in terms of attendance records. Section 3- A stipend, based on attendance, shall be awarded to members at the end of each academic semester. The base amount shall be determined by the number of semesters the member has been in band. Section 4- Individual practice time will not be counted toward the stipend. Individual practice time will only be counted for concert attendance under the terms of Section 8, Part 3. Section 5-Attendance shall be based on a percentage, where full attendance equals 100%. At the interval from 85% to 100%, the full amount of the stipend shall be awarded. At or below 84% attendance, the stipend shall decrease by x amount per hour of rehearsal missed. The deduction will vary each semester. A member must have at least 20% of band function hours to receive a stipend. Section 6- Game, concert, and rehearsal attendance will be weighted differently for determination of the stipend amount. The Governing Board will determine this factor (e.g., a concert is worth more than a game, which in turn is worth more than a rehearsal). Section 7- The conductor, Governing Board, and section leaders have the option to exclude anyone from a concert on basis of attendance. Section 8- To be eligible to perform with the band in concert, band members must have a strong record of regular attendance, with little to no record of unexcused absences. In addition, all members must attend the final rehearsal which immediately procedes the concert. The Director reserves the right to make exceptions to the final rehearsal cause for unusual circumstances. Article
XI- Quorum Regulation
Section 1-A quorum (more than 50%
of the band) shall be necessary for any voting of officers or
Constitution amendments.
Section 2- Members not present for voting meetings shall forfeit their vote. Article
XII- Jazz Ensembles
Section 1-
Members of the Band and/or Orchestra will be given first consideration
for membership in a Jazz Ensemble. People who are not members of
Band and/or Orchestra may be members of a Jazz Ensemble at the
discretion of the conductor. Such a member could be asked to
leave said Jazz Ensemble at any time at the decision of the Conductor
and the Director of Small Ensembles.
Article
XIII- Pep Band
Section 1- Members of the Band
will be given first consideration for membership in the Pep Band.
People who are not members of the Band may be members of the Pep Band
and the discretion of the Governing Board and Conductor, and providing
seating is available.
Section 2- No stipend shall be awarded to those only in the Pep Band. Section 3- Pep Band members must consent to Pep Band regulations set forth by the Governing Board and the Conductor. Article
XIV- Parliamentary Procedure
Section 1- The parliamentary
authority shall be the current edition of Robert’s Rules of Order,
Newly Revised.
Article
XV- Amendments
Section 1- All amendments to this
Constitution require previous notice of two weeks prior to being
discussed and voted upon.
Section 2- All amendments require a 3/4 vote of a quorum for adoption. Section 3- Amendments become effective only after approval by both the Office of Student Development and the Student Senate of the Marquette University Student Government (MUSG).
